The U.S. Supreme Court has been expanding the rights individuals and organizations can claim under the Constitution’s Free Exercise Clause while reducing the protection that the Establishment Clause provides for the separation of religion and government. Particularly in conjunction with state laws that purport to elevate religious rights over those of LGBTQ+ people, which have broadly expanded in recent years, this still ongoing project has the unfortunate potential to undermine the latter rights. This webinar examines relevant constitutional precedents and other recent legal developments as well as possible future directions in which the current Supreme Court supermajority could take the country.
