The Supreme Court and Trans Sports

On January 13, 2026, the Supreme Court heard oral arguments in two cases involving state restrictions on transgender participation in sports: West Virginia v. B.P.J. and Little v. Hecox. These cases raise two important questions that could significantly impact transgender people in the U.S. First, justices will decide whether restrictions on transgender sports participation violate the prohibition on sex discrimination in education programs under Title IX. Second, they will consider whether these bans violate the Equal Protection Clause of the 14th Amendment to the Constitution. Williams Institute scholars and other experts discuss the importance of the case, the oral arguments, and what these cases could mean for transgender youth.
